Understanding the Culture & Heritage Chapter

The purpose of the Culture and Heritage chapter is to acknowledge the integral role of NStQ Artifacts in the continuation of NStQ culture, values and traditions. It will also define NStQ’s ability to promote and protect the language, culture and heritage.

 

NStQ Law

NStQ will make laws (applicable on NStQ Land) to:

  • Protect, designate and manage Heritage Sites and Artifacts Provide public access to the Heritage Sites
  • Allow an NStQ Public Institution to provide NStQ language and culture education
  • To preserve, promote and develop the NStQ language and culture.

 

What is the Culture and Heritage Chapter Important?

  • Indigenous knowledge: preserving traditional knowledge, oral traditions, languages, ceremonies, and practices connected to the land.
  • Archaeological resources: Identify and describe known or potential archaeological sites.
  • Cultural landscapes: Detail traditional land-use areas that have spiritual, historical, and cultural significance. Records: Manage research, consultation processes, field assessments and archaeological studies.

Culture and Heritage – Main Points

If Canada or BC find or receive any NStQ archaeological human remains or associated burial objects, the remains will be transferred to NStQ at NStQ’s request.

BC and NStQ will discuss and attempt to reach an agreement for the conservation and protection of Heritage Sites in NStQ Territory. Before the conclusion of the Treaty, NStQ and BC will address artifacts that are recovered from Heritage Sites located off NStQ Land in NStQ Territory.

Requires BC to name or rename certain geographic features set out in the Treaty with Secwepemc names, and allows NStQ to propose/request BC to name or rename other geographic features with Secwepemc names.

Allows for NStQ to make arrangements with both BC and Canada with respect to NStQ Artifacts in museums. Canada and NStQ will negotiate arrangements related to NStQ Artifacts in the permanent collection of Canadian Museum of Civilization.

The Treaty will include a list of all the NStQ Artifacts in the permanent collection of the Royal BC Museum, and this chapter states the legal interests in those artifacts will be transferred to NStQ and allows the Royal BC Museum and NStQ to agree to custodial arrangements for the NStQ Artifacts to remain at the museum.
